This website is operated by Maxim Nekhoda. Throughout the site, the terms “we”, “us” and “our” refer to Maxim Nekhoda. Our Privacy Policy has been compiled to describe as accurately as possible how we collect and use your Personally Identifiable Information (PII). Personally Identifiable Information, as described by United States privacy laws and information security standards, is information that can be used on its own or in combination with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our Privacy Policy carefully to get a clear understanding of how we collect, use, and handle your Personally Identifiable Information and Non-Personally Identifiable Information (Non-PII).

SECTION 1 - WHAT INFORMATION DO WE COLLECT?

Voluntary submission: When ordering products, creating accounts, or signing up for electronic communications on our website, you may be asked to enter your name, email address, mailing address, phone number, credit card information and other personal information. Such instances of PII collection require your expressed permission and are never performed without your knowledge or consent.

Automatic collection: When you browse our store, we automatically receive your computer’s public Internet Protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. This information is not directly tied to your personal identity, and is used solely for the purposes of improving your browsing and shopping experience by ensuring system compatibility.

Email marketing: With your expressed permission, we may send you emails about our store, new products, promotional offers, discount codes and other updates. You can opt out of this correspondence at any time.

SECTION 2 - WHEN DO WE COLLECT INFORMATION?

We collect information from you when you register on our website, place an order, subscribe to a newsletter, respond to a survey, fill out a form, provide us with feedback on our products or services, use Live Chat, open a support ticket or enter information on our site. Your public IP address is detected automatically when you visit our website.

We may use the information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, browse the website, or use certain other site features in the following ways:

SECTION 6 - THIRD-PARTY SERVICES

We do not trade or sell your personal information to third-parties. In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us, which are in turn required to fulfill the services expressly solicited by you.

Additionally, your Non-Personally Identifiable Information (such as the total number of visitors who browse our website), may be provided to third-parties for marketing, advertising, or other uses. Please note that we allow third-party behavioral tracking, as applicable to Non-Personally Identifiable Information.

Certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in, or have facilities that are located in, a different jurisdiction than either you or us. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy.

Occasionally, at our discretion, we may include or offer third-party products or services on our website. These third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about the third-party websites we link to.

SECTION 8 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure your information is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is immediately encrypted using Secure Socket Layer technology (SSL) and stored with an AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards. As a result, online purchases are statistically safer than using your credit card at a restaurant, department store, or other physical locations. Similar security and encryption protocols are currently employed by financial institutions to store and transmit your information during internet banking transactions.

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your expressed consent to allow any of your minor dependents to use this site.

SECTION 12 - CHILDREN'S ONLINE PRIVACY PROTECTION ACT (COPPA)

In accordance with COPPA, parents and legal guardians have complete control over the personal information being collected from children under the age of thirteen (13). The Federal Trade Commission, United States' consumer protection agency, enforces the COPPA Rule. For additional information, please see the Children’s Online Privacy Protection Act (COPPA).

Maxim Nekhoda enforces the rules outlined in Section 12 of our Privacy Policy regarding the age of consent as applicable to the collection and use of personal information.

We do not specifically market to children under the age of thirteen (13).

SECTION 13 - CALIFORNIA ONLINE PRIVACY PROTECTION ACT (CalOPPA)

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law's reach stretches well beyond California to require any person or company in the United States (and conceivably the world) that operates websites collecting Personally Identifiable Information from California consumers to post a conspicuous privacy policy on their website stating exactly the information being collected and those individuals or companies with whom it is being shared. In compliance with CalOPPA, we agree to the following:

  1.  Users can visit our website anonymously.

  2. Once our Privacy Policy is created, we will add a link to it on our home page or as a minimum, on the first significant page after entering our website.

  3. Our Privacy Policy link includes the word 'Privacy' and can easily be found on the page specified above.

  4. You will be notified of any Privacy Policy changes on our Privacy Policy page, which specifies when the policy was last updated.

  5. You can change your personal information by logging into your account or contacting us in accordance with Section 17 of our Privacy Policy.

SECTION 14 - CAN-SPAM ACT

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to:

  1. Send information, respond to inquiries, and/or other requests or questions;

  2. Process orders and to send information and updates pertaining to orders;

  3. Send you additional information related to your product and/or service; and

  4. Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.

In compliance with the CAN-SPAM Act, we agree to:

  1. Not use false or misleading subjects or email addresses;

  2. Identify the message as an advertisement in some reasonable way;

  3. Include the physical address of our business or site headquarters;

  4. Monitor third-party email marketing services for compliance, if one is used;

  5. Honor opt-out/unsubscribe requests within a reasonable time frame; and

  6. Allow users to unsubscribe by using the link at the bottom of each email.

If at any time you would like to unsubscribe from receiving future emails, follow the instructions at the bottom of each email, and we will promptly remove you from all correspondence.

SECTION 15 – ONLINE ADVERTISING AND RE-MARKETING

Maxim Nekhoda uses third-party vendor re-marketing tracking cookies, including the Google Ads (formerly Google AdWords) tracking cookie. Third-party vendors whose services we employ, including Google, may place cookies in your local web browsers folders in order to monitor your activities on our website and collect Non-Personally Identifiable Information (Non-PII), such as which pages you viewed. This Non-PII may be used to tailor our marketing to better suit your needs and only display advertising which is relevant to you.

Maxim Nekhoda collects data about your activities that does not personally or directly identify you when you visit our website or the websites and online services where we display advertisements (our “Publishers”). We may show targeted adverting to you via our Publishers, which may include the Google search results page, third-party websites which participate in the Google Display Network (GDN), as well as other third-party websites. As always we respect your privacy and never collect or use any Personally Identifiable Information for re-marketing purposes.

You may opt out of the automated collection of information by third-party ad networks for the purpose of delivering advertisements tailored to your interests by visiting the consumer opt-out page for Google Ads Settings.

SECTION 16 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time. You can review the most current version of our Privacy Policy at any time on this page. We reserve the right to update, change or replace any part of this Privacy Policy by posting updates and/or changes to our website. Please review our Privacy Policy frequently so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
